The Duty to Stop

Virginia Code, § 46.2-894, states that the driver of a vehicle involved in an accident in which a person is [hurt or property is damaged] . . . [must] . . . immediately stop as close to the scene of the accident as possible without obstructing traffic.

The Duty to Report the Accident

Drivers involved in an accident described above have a duty to the following information to State Police or local law-enforcement, as well as the person injured (or who’s property/car was damaged), plus any driver or passenger who suffered harm:

  • Name of Driver
  • Driver’s License Number
  • Vehicle Registration Number

The Duty to Render “Reasonable Assistance”

Virginia Code, § 46.2-894, states, ” . . . The driver [involved in an accident] shall also render reasonable assistance to any person injured in such accident, including taking such injured person to a physician, surgeon, or hospital if it is apparent that medical treatment is necessary or is requested by the injured person.”
