Pendente Lite refers to an order that is awaiting litigation. Most often, Pendente Lite is used for the temporary issuance of alimony (spousal support), custody, visitation, child support, and possession of the family home, which is effective until the final divorce decree is issued. Spouses either agree upon these terms or the courts make these determinations based on both spouses’ incomes and the best interests of the child(ren).
