Non-marital property, also known as separate property, is any property solely owned by one spouse, which was either acquired prior to the marriage or received individually during the marriage via gifts or inheritances, or purchased with income earned prior to the marriage. Determination of non-marital property can only be made by mutual agreement or by the judge.
